Off-street parking places - electric vehicle recharging bays variation order: Ellesmere Port and Neston
Proposed orderNOTICE is hereby given that Cheshire West and Chester Borough Council proposes to make the above-named Order in exercise of its powers under Sections 32, 33 and 35 of the Road Traffic Regulation Act 1984 and of all other enabling powers.
The effect of the Order will be to provide for electric vehicle recharging bays and prevent use by other vehicles or by electric vehicles when not charging. Bays are being introduced in Shrewsbury Road, Ellesmere Port and Chester Road, Neston but the Order will enable control of such bays at other car parks in Ellesmere Port and Neston if introduced in the future.

Any objections to the draft Order should be sent in writing, stating the grounds of the objection, to the undersigned to arrive no later than Friday 14th May 2021. Any representations received may become available for public inspection.

Draft orderThe Cheshire West and Chester Borough Council (“the Council”) in exercise of its powers under Sections 32, 33 and 35 of, and Part IV of Schedule 9 to, the Road Traffic Regulation Act 1984 as amended (“the 1984 Act”), the Traffic Management Act 2004 and of all other enabling powers, and after consulting with the Chief Officer of Police in accordance with Part III of Schedule 9 to the 1984 Act, hereby makes the following Order:
1. This Order shall come into operation on >>> 2021 and may be cited as the Cheshire West and Chester Borough Council (Off-Street Parking Places, Ellesmere Port and Neston) (Electric Vehicle Recharging Bays Variation) Order 2021.
2. The Cheshire West and Chester Borough Council (Off-Street Parking Places, Ellesmere Port) Order 2013 is hereby varied as follows:
2.1 The following definitions are added at Article 2.1 (Interpretation):
“Electric Vehicle” means a Vehicle in which the electrical motive power is derived from an internal electrical storage battery that can be plugged into mains electricity for the purpose of Recharging the said battery and shall include any Vehicle that is so powered in part by such a battery, including plug-in hybrid and extended-range electric vehicles;
“Electric Vehicle Recharging Point” means equipment situated adjacent to a Parking Bay reserved for Electric Vehicles that supplies electric energy for recharging the battery of Electric Vehicles via connection to an electric cable;
“Recharging” in relation to an Electric Vehicle means the Electric Vehicle is connected by electric cable to an Electric Vehicle Recharging Point situated adjacent to a Parking Bay reserved for Electric Vehicles for the purpose of recharging the battery of the Electric Vehicle.
2.2 The following article is inserted after Article 11:
“Electric Vehicle Recharging Bays
11A No person shall cause or permit a Vehicle to wait in a Parking Bay marked as reserved for Recharging of Electric Vehicles unless:
i) it is an Electric Vehicle;
ii) it is Recharging; and
iii) it does not wait in excess of any permitted period indicated by notice on site.”
2.3 The words “and Neston” are added to the title of the Order after the words “Ellesmere Port”, and new Schedule 10 below is inserted in respect of Chester Road, Neston Car Park.
